Abstract:

The contracts on immovable property were first provided under the Turkish consumer law by the Law, numbered 4822 of 2003 which amended the Law on Consumer Protection, numbered 4077. The same approach is also adopted in the new Law on Consumer Protection, numbered 6502 that came into force on 28th May 2014. The Law covers the contracts on immovable property, concluded under certain conditions, the contracts on the sale of immovable property being the most important type of such contracts. However, all other contracts subject of which is an immovable property are also covered by the Law. This article aims to analyse the conditions and consequences of liability for defect as regards the contracts on immovable property, with a special emphasis on the contracts on the sale of immovable property
