Fıkıh ilminin iki temel kaynağı olan Kur’ân-ı Kerim ve sünnetin ortaya koyduğu genel prensiplerin yaşanan hayat açısından bir değer ifade etmesi ancak onların yaşama geçirilmesi ile mümkün olabilir. Bu da aklî yetinin dünyayla ilgili işlerde kullanılarak düşünce üretilebilmesi ile gerçekleşebilir. Fıkıh ilminin olgusal gerçeklikle ilişkisini kuran bir hukuk üretim biçimi olarak fetva, doktriner anlamda hukukî yorumlama ve hukukun gelişimine katkı sağlayan faktör olmuştur. Bu bağlamda, Osmanlı Türkçesi fetvalar, dinin açık ve yerleşik bir hükmünün aktarılması veya açıklanması mahiyetinde olduğunda Şarî‘in hükmünü açıklama olarak değer hükmü taşırken, Kur’ân ve sünnette hakkında hüküm bulunmayan bir konuda dinî hükmün araştırılması mahiyetinde olduğunda ise fıkhî yorum, re’y ve içtihat olarak değer hükmü taşımaktadır. Diğer taraftan Osmanlı Türkçesi fetvalardaki bilgiler, özellikle kaynak değerlendirmesi ve hükme erişme ve hüküm çıkarma yöntemleri ve sonraki asırlarda ortaya çıkan yeni problemlere cevap üretilebilmesi ile fıkıh mirasımız açısından son derece önem arz etmektedir. Ayrıca birey ve toplumla ilgili konularda yetkili mercilerce verilen söz konusu fetvalar hem halkın dini konularda bilgilendirilip aydınlatılmasına, hem de Müslüman toplumlarda İslam’ın anlaşılması ve uygulanmasına yardımcı olmuştur. Bu bağlamda, fıkıh ilminin canlılığında ve gelişmesinde önemli ölçüde pay sahibi olmuş Osmanlı Türkçesi fetvalar, hem teorik yönden fıkıh doktrini de besleyen bir literatür olması bakımından, hem de adli sahada geniş ölçüde kaza birliğinin oluşmasına ve aynı ilmi disiplin içinde iç denetimin sağlanmasına hizmet etmesi gibi pratik/uygulama yönünden kaynak değer ifade etmektedir.
It is possible that the two basic sources of fiction, the Qur’an and the general principles revealed by the Sunnah, express a value in terms of life, but with their transition to life. This can also happen by using the mindfulness in the work of the world. As a form of law production that establishes the relationship of fiction with the real reality, fetva has been a factor contributing to the development of law and the interpretation of law in the doctrinary sense. In this context, the Ottoman Turkish fetvals, when it is in the process of transmitting or explaining a clear and established judgment of the religion, the judgment of the Sharia is valuable as an explanation, while when it is in the process of investigating the religious judgment on a matter that is not in the Quran and the Sunnah, the fictional explanation is valuable as a re'y and drinking judgment. On the other hand, the information in the Ottoman Turkish fetuses, especially the assessment of the resources and the methods of access and judgment and the response to the new problems arising in the next centuries, is of great importance in terms of our fictional heritage. Furthermore, those fetals given by the authorities in matters relating to individuals and society have both inform and illuminate the people in religious matters and the understanding and implementation of Islam in Muslim communities. In this context, the Ottoman Turkish fetvals, which have a significant part in the vitality and development of the science of fiction, expresses the source value from the practical/application direction, as well as from the point of view that it is a literature that feeds the theoretical doctrine of fiction, as well as from the point of view that it serves the formation of a large-scale unity of accidents in the judicial field and the provision of internal control within the same science discipline.
