Töre (örf ve adet); yazılı hukuk kurallarının olmadığı dönem ve toplumlarda toplumsal hayatı düzenleyen, toplum tarafından benimsenmiş ve davranış şekline dönüşmüş kurallardır. Bir toplumu incelemek, tanımak ve analiz etmek için o toplumun örf ve adetlerini, kültürünü incelemek gerekir. Toplumların hayata bakış açılarını, düşünce dünyalarını ve yaşam şartlarını yansıtan örf ve adetler bir bakıma toplumların yansımasıdır. Toplumun en küçük sosyal birimi olan ailenin kurulması, çok eski zamanlardan bu yana birçok gelenek ve göreneğin gözlemlendiği tören ve merasimler olarak ön plana çıkmıştır. Modernleşen dünya ile birlikte birçok örf ve adet unutulmaya başlamışken evlilik sürecindeki örf ve adetler halen yaşatılmaktadır. Türkler Orta Asya’da yaşamış ve tarihsel süreç içinde Anadolu Bölgesi’ne göç etmiş bir halk topluluğudur. Göçebe bir yaşam kültürüne sahip olan Türklerle ilgili kaynak sayısı çok azdır. Bunun nedeni o dönemde sözlü anlatıma değer verilmesi ve devamlı hareket halinde olan bir yaşam tarzıdır. Ayrıca yazı için gerekli araç ve gereçlerin temininin güçlüğü, insanların gündelik hayatlarını kolaylaştıran araç ve gereçlere önem vermesi de en önemli nedenlerdendir. Ancak o dönemden günümüze gelen eserler az da olsa Türk töresi ve o dönem hakkında fikir edinmemizi sağlayacak ve günümüze ışık tutacak niteliktedir. İslamiyet, M.S 6.yüzyılda Arabistan yarımadasında ortaya çıkmış, söylemi tüm dünyayı kapsayan bünyesinde itikadi, ameli ve ahlaki hükümler bulunduran semavi bir dindir. Allah’ın gönderdiği rehber kitap ve o kitabı insanlara öğreten peygamberin davranışlarıyla şekillenmiştir. Allah(c.c)’ın ifadesiyle ‘‘en güzel örnek’’ olarak yaşayan peygamber; hükümleri insanlara anlatmış, uygulamış ve anlaşılamayan kısımları netleştirmiştir. İslam dini, muhatabının hem bu dünyadaki yaşamını hem de bu dünyadan sonraki yaşamını düzenlemek amacındadır. Bu bağlamda kuralları ve hükümleri oluşmuş, her dönem güncel meseleler üzerinden yenilenerek günümüze kadar gelmiştir. Bu çalışmada, iki kültürün toplumun temeli sayılan aile kurumuna bakış açıları incelenmiş, Türk töresi ve İslam hukukunun hem törensel anlamda hem hukuksal anlamda aile kurma ve evlilik hususundaki hüküm ve kuralları araştırılmış ve iki hukuk sisteminin benzerlikleri ve farklılıkları karşılaştırılmıştır.

The Turkish people have lived in Central Asia and have migrated to the Anatolian region in the historic process. The number of sources related to the Turkish people who have an immigrant life culture is very small. This is due to the value of the verbal narrative in that period and a lifestyle that is constantly moving. In addition, the difficulty of providing the necessary tools and tools for writing is one of the most important reasons that people pay attention to the tools and tools that make their daily lives easier. But the works that come from that period to the present day will make it possible for us to get an idea about the Turkish ceremony and that period and will keep light to the present day. Islamism, which appeared in the 6th century BC in the Arab Peninsula, is a semavian religion that has religious, practical and moral provisions within the speech that covers the whole world. The guidance of God is formed by the behavior of the Prophet who taught people the Book and the Book. The Prophet (peace and blessings of Allah be upon him) is the best of all, and the best of all, and the best of all, and the best of all. The Islamic religion is intended to organize both his life in this world and his life after this world. In this context, the rules and regulations have been formed, and every period has been renewed through current matters until today. In this study, the views of the family institution, which is the foundation of the society of two cultures, and the provisions and rules of the Turkish ceremony and Islamic law, both in the ceremonial and legal sense, regarding the establishment of family and marriage, and compared the similarities and differences of the two legal systems.
