Önödeme hukukumuzda uzun süredir uygulanan alternatif çözüm yöntemlerindendir. Bu usulün uygulanmasına ilişkin kurallar, 5237 sayılı Türk Ceza Kanunu’nun 75. maddesinde düzenlenmiştir. Önödeme, 5271 sayılı Ceza Muhakemesi Kanunu’nun 253 ile 255. maddeleri arasında düzenlenen uzlaştırma kapsamındaki suçlar bakımından uygulanamaz. Esasen yalnızca adli para cezası gerektiren veya yukarı sınırı altı ay hapis cezasını aşmayan suçlarda uygulanabilen önödemenin kapsamına, Türk Ceza Kanunu’nda sayılan bazı özel suç tipleri de eklenmiştir. 24.11.2016 tarihli 6763 sayılı Kanun ve 17.10.2019 tarihli 7188 sayılı Kanunla birlikte önödemenin daha fazla suç için uygulanması amaçlanmış ve taksitle ödeme gibi kolaylıklar getirilmiştir. Bu çalışmada, önödemenin tarihsel gelişimi genel olarak incelendikten sonra, önödemenin hukuki niteliğine ilişkin öğreti görüşlerine yer verilecektir. Uygulama açısından önem arz eden önödemenin şartları, alt başlıklar halinde açıklanacak ve önödemenin hukuki sonuçları ortaya konulacaktır. Bu çerçevede yapılan açıklamalarda, Yargıtay kararları ve doktrindeki görüşler de ele alınacaktır. Nihayet sonuç kısmında, önödemeye ilişkin istatistiki bilgiye yer verildikten sonra, 5237 sayılı Türk Ceza Kanunu’nun 75. maddesindeki düzenlemeye ilişkin çözüm önerileri sunulacaktır.
Prepaid is one of the alternative methods that have been applied for a long time in our law. The rules for the implementation of this procedure are regulated in Article 75 of the Turkish Criminal Code No. 5237. Preliminary payment shall not be applied for crimes within the scope of reconciliation under Articles 253 to 255 of the Criminal Procedure Act No. 5271. Basically, some special types of criminal offences listed in the Turkish Criminal Law have been added to the scope of prejudice for crimes that only require a criminal penalty or which may be applied in crimes that do not exceed the maximum of six months of imprisonment. The Law No. 6763 of 24.11.2016 and the Law No. 7188 of 17.10.2019 aimed at the application of prepaid for more crimes and facilities such as tax payments were brought. In this study, after examining the historical development of the pre-payment in general, the teaching views on the legal nature of the pre-payment will be included. The conditions of the priority that are important in terms of application will be explained in subtitles and the legal consequences of the priority will be revealed. In this framework, the statements will also discuss the judgments of the Court and the opinions in the doctrine. In the final result section, after the statistical information on the prepaid will be included, the solution proposals on the regulation in Article 75 of the Turkish Criminal Code No. 5237 will be submitted.
