Katılım Bankalarında Fon Yönetimi: Sukuk Uygulaması

Klasik bankacılık toplumun finansal ihtiyaçlarını fon toplama, fon kullandırma ve genel bankacılık hizmetleri üzerinden gidermektedir. Bu üç finansal hizmetin faizsizlik prensibine bağlı kalınarak yerine getirilmesi hususu Faizsiz Bankacılık oluşumunu gündeme getirmiştir. Katılım bankaları özellikle faiz hassasiyeti olan kesimin tasarruflarının reel ekonomiye kazandırılmasında çok önemli bir işleve sahiptir. Katılım bankalarını faizli bankalardan ayıran temel ayırıcı özellikleri fon kullandırma yöntemleridir. Katılım bankacılığında kullanılan yöntemler; fon toplama ve fon kullandırma yöntemleri olarak iki başlıkta değerlendirilmektedir. Fon toplama yöntemleri; özel cari hesaplar ve katılım hesapları olarak iki şekilde gerçekleşmektedir. Fon kullandırma yöntemleri ise klasik bankaların faizden arındırılmış yöntemlerinden (murabaha, mudaraba, müşareke, icara, selem, istisna, teverruk, tekafül, komodite, karz-ı hasen, risk sermayesi ve sukuk) oluşmaktadır. Sukuk faiz ödemeyi veya faiz masrafı yüklemeyi yasaklayan İslam hukuku prensiplerine uyan menkul kıymetlerdir. Sukuk, finansman ve ticari işlemlerde kullanma şekillerine göre çeşitlilik göstermektedir. Sukuk çeşitleri, temelde sukukun konusu olan malın çeşidine göre; mal satımına dayalı sukuk, menfaat satımına dayalı sukuk ve ortaklık esasına dayalı sukuk olarak üç ana başlıkta derlenebilmektedir. Murabaha, selem ve istisna sukuku konu itibariyle mal satımına dayalı bir sözleşme içeren sukuk çeşitleridir. İcara sukuku menfaat satımına dayalı, muşaraka ve mudaraba sukuku ise ortaklık esasına dayanan sukuk türleridir. Teorik bazda yürütülen bu çalışmada da öncelikle katılım bankalarının kuruluş amaçlarına ve kurulmasında etken olan faktörlere değindikten sonra katılım bankalarında fon kullandırma yöntemlerinden biri olan Sukuk’un avantajlarına ve dezavantajlarına, sukuk’un işleyişine ve sukuk türlerine ayrıntılı olarak yer verilmiştir.

Classic banking addresses the financial needs of the society through fundraising, fund raising and general banking services. The fact that these three financial services were fulfilled on the principle of interest-free brought the formation of Interest-Free Banking to the agenda. Participation banks have a very important function in bringing the savings of the sector with interest sensitivity to the real economy. Funding methods are the main distinguishing features that differentiate participation banks from interest banks. Methods used in participation banking; fund collection and fund utilization methods. Fund collection methods; private accounts and participation accounts in two ways. The methods of using funds consist of interest-free methods of classical banks. Sukuk is the securities that comply with the principles of Islamic law, which prohibits the payment of interest or interest charges. Sukuk varies according to the way it is used in financing and commercial transactions. Sukuk types, basically the subject of the sukuk is the type of goods; sukuk based on the sale of goods, sukuk based on the sale of interests and sukuk based on the partnership basis can be compiled under three main headings. Murabaha, selem and sukuk are the kinds of sukuks that contain a contract based on the sale of goods. İcara sukuk is based on the sale of interest, musharaka and mudaraba sukuk are sukuk types based on partnership. In this theoretical study, first of all, the advantages and disadvantages of Sukuk, one of the methods of fund raising in participation banks, the functioning of sukuk and the types of sukuk were discussed in detail.
