Selçuklularda, Memlüklülerde ve özellikle Osmanlı Devleti’nde kadıların verdiği kararlar ve tuttuğu zabıtlar, tarih sırasına göre kadı sicili denen defterlere kaydedilmiştir. Bu defterlere Şer’iyye sicilleri, mahkeme defterleri, zabt-ı vakayi sicilleri veya sicillat defteri de denmektedir. Tarihî kaynaklarımızın en önemlilerinden birisi de şer’iyye sicilleridir. Bu siciller, kadıların gittikçe genişleyen yetki ve hizmet alanlarına göre önem kazanmışlardır. Şer’iye sicilleri Osmanlı Devleti’nin askeri, hukuki, iktisadi, dini ve idari müesseseleri gibi birçok alanı hakkında önemli bilgiler içermektedir. Şer’iye sicilleri XV. asrın yarısından XX. asrın ilk çeyreğine kadarki Türk kültür ve tarihine ışık tutması açısından Osmanlı tarihinin en önemli kaynakları arasındadır. Bu siciller kadıların merkezle yaptığı resmî yazışmaları; ilgili olduğu yerin tarihi, sosyal, kültürel, ekonomik, dinsel, hukuki ve idari gelişmelerini içermesi bakımından önemlidirler. Siciller, ait olduğu yerin eski yerleşim birimlerini, buradaki insanlara verilen lakapları, insanların birbiriyle olan ticari münasebetlerini, sosyal yaşamlarını, ekonomik durumlarını, hukuki münasebetlerini içermektedir ve şer’i mahkemeler hakkında önemli bilgiler vermektedir. Son zamanlarda ortaya çıkan şehir tarihleri ve yurdun çeşitli bölgelerindeki mahallî hayata ait ilmi araştırmaların birinci derecede kaynağı şer’iyye sicilleridir. Sadece Türkiye sınırları içinde yer alan toprakların değil, Osmanlı Devleti’nden ayrılan toprakların da gerçek tarihi bu vesikalar incelendikten sonra yazılabilir. Bu nedenle Osmanlı tarihini açıklığa kavuşturmak için bu belgelerin günümüz Türkçesine çevrilmesi ve dikkatle incelenmesi gerekmektedir. 98/3 numaralı Gaziantep Şer’iye Sicili’nin mikrofilmleri Ankara’daki Millî Kütüphane’de bulunmaktadır. İçinde 74 tane belge vardır. Biz bu çalışmada Gaziantep’in 1742-1743 yıllarındaki sosyal, hukukî durumunu ve bu dönemde adı geçen şehirdeki yer adlarını ortaya koymaya çalıştık.
