So many results that aren't mine?

Abstract:

Osmanlı toplumunda hukuk sistemi olarak İslâm hukukunun uygulandığı ve hukuk ekolü olarak da Hanefî mezhebine bağlı kalındığına dair yaygın bir kanaat bulunmaktadır. Yine Müslüman toplumlarda, İslâm hukukuna daha çok bağlı kalınan hukuk dalının Aile hukuku olduğu ileri sürülmektedir. Bu çalışmamızda, Osmanlı devletinin kurulduğu bölge olan Bursa’daki mahkemelere intikal eden ve duruşması yapılıp karara bağlanan hükümlerin yer aldığı 17. yüzyıl şer’iye sicillerine ait iki defter veri tabanı olarak alınıp İslâm aile hukuku açısından tahlili yapılmıştır. Osmanlı toplumunda İslam Aile hukukuna bağlı kalınan noktalar ile farklı uygulamalar tespit edilmeye çalışılmıştır

Abstract:

In the Ottoman society, there is a widespread claim that Islamic law is applied as a legal system and that it is also connected to the Hanefî religion as a legal supplement. In Muslim communities, the branch of law that remains more attached to Islamic law is the family law. In this work, the two registers of the 17th century sheriff, in which the rulings in which the courts in Bursa, the region where the Ottoman state was established, were taken as the database of the registers, and the Islamic family law was evaluated. In the Ottoman society, different practices have been attempted to be identified with points connected to the Islamic Family Law.
