İslâm hukukunda doğumla başlayan ve ergenlik çağına kadar devam eden döneme “çocukluk” denir. Bu dönemi yaşayan kimseye de “çocuk” denir. Çocukluk döneminin kendi içinde evreleri vardır. Çocuğun anne karnına düşmesinden itibaren ergen oluncaya kadar geçen sürede bir takım hak ve ödevleri vardır. Çocuklara dair hak ve ödevler, İslam hukukunda ve pozitif hukukta garanti altına alınmıştır. Yaşama hakkı, soy isim hakkı, vatandaşlık hakkı gibi kabz gerektirmeyen haklar sağ doğmak şartıyla ceninlik döneminden itibaren başlar. Bunlara ilaveten çocukların, ebeveynlerini, akrabalarını tanıma ve soy isim hakkı, vatandaşlık hakkı, miras ve mülk edinme hakkı, süt emme, iyi beslenme, giyinme, barınma gibi bakım hakları, büyükleri tarafından çocuklara değer verilmesi, sevgi ve merhamet ile himaye edilmesi, kötü kötü alışkanlıklardan korunma hakları, oyun oynama hakkı, terbiye ve iyi eğitim alma haklarını da sayabiliriz. Çocuk haklarının bilinmesi ve bu haklara saygı duyulması onların biyolojik ve psikolojik gelişimine de katkı sağlar. Çocukların her türlü şiddetten, istismardan uzak kalmaları, hayatta başarılı, uyumlu huzurlu olabilmeleri, toplumsal barışa ve güvene katkı sağlayabilen bireyler olabilmeleri için çocuk haklarına riayet etmek gerekir. Toplumdaki ailelerin ve bireylerin çocuk hakları konusunda bilinçlendirilmesi gerekir. İşte biz bu tebliğimizde genel olarak İslam’ın çocuğa bakışını ve çocukların genel haklarını konu edindik.
In Islam, the period that begins with birth and continues until adolescence is called "childhood". Anyone who lives in this period is called a child. The childhood period has its own stages.
