Abstract:

Gokalp advocated the adoption of revised and a new lifestyle for the society where lived. The Law is the most important element of the change in the world of his thoughtIn this context, Gokalp proposed a new method based on “Orf/tradition” instead of Islamic legal method which was insufficient to solve new problemHe named this new method as a “Social Methods of the Fiqh”. In contrast Izmirli Ismail Hakki had strongly opposed to Ziya Gokalp thoughts and advocated the renewal of the legal method should be done in the framework of the classical principleFor this purpose, He had also seriously and scholarly criticized Ziya Gokalp’s “Social Methods of the Fiqh.” Izmirli evaluated and described Gokalp’s proposals which were built on unsubstantiated opinions.
