1982 Anayasasında yapılan 2017 değişiklikleri öncesinde Türkiye’de parlamenter hükümet sistemi benimsenmiştir. Ancak cumhurbaşkanının vesayetini doğuracak nitelikteki olağanüstü yetkiler sebebiyle parlamenter sistemden önemli ölçüde uzaklaşılmış, sistem cumhurbaşkanının etkin vesayeti sebebiyle yarı-başkanlık sistemine benzer bir modele bürünmüştür. Cumhurbaşkanına verilen olağanüstü yetkiler sistemin kendine özgü güçlüklere hapsolmasına yol açmış karar alma süreçlerinin tıkanmasının bir sonucu olarak pek çok siyasî krizle karşılaşılmıştır. Parlamenter sistemin özüne aykırı bir şekilde güçlü bir cumhurbaşkanlığı makamının oluşturulması ve yarı-başkanlık sisteminden bile geniş sayılabilecek yetkilerine karşı sorumsuz bir cumhurbaşkanı, kamu hukukunun temel ilkelerinden olan “yetki ve sorumlulukta paralellik ilkesi” açısından bir paradoks doğurmuştur. İlkeye göre yetki ile sorumluluk paralellik arz etmeli yetki, sorumluluk derecesinde olmalıdır. Başka bir ifadeyle sorumsuz bir cumhurbaşkanı aynı zamanda yetkisiz kılınmalıdır. Oysa 2017 değişiklikleri öncesinde sorumsuz cumhurbaşkanlığı makamına karşılık, güçlü ve geniş yetkili bir cumhurbaşkanlığı makamı benimsenmiştir. Bu yönüyle benimsenen sistem, yetki ve sorumlulukta paralellik ilkesi açısından da tartışmalı hale gelmiştir. Bu çalışmada öncelikle kavramsal açıdan yetki ve sorumlulukta paralellik ilkesi ve kuvvetler ayrılığı bağlamında hükümet sistemleri açıklanmıştır. Çalışmanın devamında devlet başkanlarına tanınan yetkilere karşılık sorumluluğun dengesi ölçütünde 2017 değişiklikleri öncesi Türkiye’de cumhurbaşkanı ve 1958 Fransa Anayasası’nda cumhurbaşkanın yetki ve sorumluluğu analiz edilmiştir. Son bölümde ise yetki ve sorumlulukta paralellik ilkesi çerçevesinde olağanüstü yetkili / sorumsuz cumhurbaşkanı Türkiye özelinde inceleme konusu edinilmiştir.
Before the amendments to the Constitution of 1982 in 2017, the parliamentary government system was adopted in Turkey. But because of the extraordinary powers that will generate the president's mandate, it has been largely removed from the parliamentary system, and because of the effective mandate of the president, the system has a model similar to the semi-presidential system. The extraordinary powers granted to the president led to the system’s own difficulty; as a result of the blocking of its decision-making processes, he faced many political crises. The establishment of a strong presidency, contrary to the essence of the parliamentary system, and an irresponsible president against his powers that may be extended even to the semi-presidential system, has brought a paradox in terms of the "principles of equality and responsibility in equality and equality in equality and equality in equality and equality in equality and equality in equality and equality in equality and equality in equality and equality in equality and equality in equality and equality in equality and equality in equality. The principle is that power and responsibility must be parallel; power and responsibility must be in level. In other words, an unresponsible president must also be dismissed. The system adopted in this direction has also become controversial in terms of the principle of parallelity in power and responsibility. This study first explained the principles of parallelity in authority and responsibility in the context of the division of forces and the government systems. In the continuation of the study, the responsibility balance measurement against the powers recognized to the presidents of the state was analyzed in the presidential and presidential powers and responsibilities in the 1958 French Constitution before the 2017 changes. In the last section, the subject of examination was acquired in particular by the extraordinary authorized/responsible president of Turkey in the framework of the principle of parallelity in authority and responsibility.
