Ebû Hureyre, İslam’ın son yıllarında Rasûlullah’ın sas sahâbîsi olma şerefine nail olmuştur. Ebû Hureyre’nin, Hz. Peygamber’in vefatı sonrası çok hadis nakletmesi, bazı rivâyetlerinin kimi ashâb tarafından tahkik ve tenkid edilmiş olması, âlimlerin dikkatinin ona ve rivâyetlerine yoğunlaşmasına sebep olmuştur. Bu meyanda fukahâ, fıkıh usûlüne dair eserlerinde başta haber-i vâhid olmak üzere bazı konuları Ebû Hureyre ve rivâyetleri üzerinden ele almıştır. Ebû Hureyre’nin hadis dalındaki yetkinliği hıfz kabiliyeti , fakih ya da nakilci râvi olup olmadığı hususları, Hanefî fakihlerinin onun rivâyetlerini Kitâb, sünnet ve icmâ ile birlikte ele alıp değerlendirmelerinde etkin rol oynamıştır. Hanefî fakihler Ebû Hureyre’nin rivâyet ettiği bazı rivâyetleri kıyasla çelişmesi, Ebû Hureyre’nin de fakih râvi olmaması gerekçeleriyle amel edilebilir bulmamışlardır. Dolayısıyla senedinde sorun olmayan fakat kıyasla/asıllarla çelişen rivâyetler hakkında nasıl hüküm verilmesi gerektiği, hangi yöntem/usûl ile muârazanın çözüme kavuşturulacağı hususu Hanefî fakihlerin fıkıh usûlünün temel meselelerinden olmuştur. Hanefîler, kıyasla çelişen, selef âlimlerinin de amel etmediği Ebû Hureyre rivâyetlerini bazen farklı tevilllerle kabul ederek ma’mûlun bih kendisiyle amel dilebilir bulmuş, bazen de amel edilebilir bulmamışlardır. Onlar isnadında sorun olmayan rivâyetleri reddetmeyip, metindeki/muhtevadaki manevi inkıta dolayısıyla tenkit etmişlerdir
