Toplumsal bir olgu olarak çocuk suçluluğu Dünyada çok uzun yıllardır yaşanan ve her geçen gün sayısı gittikçe artan bir sorundur. Genel olarak 19. yüzyıla kadar suça karışan bireylere çocuk yetişkin ayrımı yapılmaksızın aynı ceza kanunlarının hükmü uygulanmıştır. 1899 yılında Chicago, Illinois’de Cook County Çocuk Mahkemesinin kurulmasıyla çocuk suçluluğuyla ilgili davalar bilimsel bir bakış açısıyla ele alınmaya başlanmıştır. Ülkemizde çocuk suçluluğuyla ilgili ilk çalışmalar Cumhuriyetin ilanından sonraki yıllarda yapılmaya başlamıştır. Daha evvelki dönemlerde yeterli istatistiklerin ve konuya ilgi duyan bilim insanlarının bulunmaması nedeniyle çocuk suçluluğu suç sosyolojisi- psikolojisi ve ceza hukukunda geç yer bulmuştur. Türkiye’de suçlu çocuklarla ilgili ilk araştırma 1931 yılında yapılmıştır. O zamandan günümüze çocuk suçluluğunun çözümüne yönelik nicel ve nitel araştırmalar sosyolojik, psikolojik ve hukuki boyutlarıyla geniş bir perspektiften ele alınmaya başlamıştır. Bu çalışmanın amacı da, ülkemizde yaşanan çocuk suçluluğu olgusunu ve bu olguya yol açan toplumsal nedenleri Antalya örneğinde araştırarak sosyolojik bağlamda anlamaktır. Araştırmanın saha verileri Temmuz-Aralık 2003 tarihleri arasında Antalya il merkezinde bulunan Antalya İl Emniyet Müdürlüğüne bağlı Çocuk Şube Müdürlüğü’ne suç isnadıyla getirilen çocuklardan oluşmaktadır. Araştırmadan elde edilen verilere göre, Antalya’da suç isnadına karışan çocukların yarıya yakını (%41) iç göç sonucu fiziki çevre değişikliği yaşamış aile çocuklarıdır. Çocukların aile ve akrabalarında suçlu modeli sayısı azımsanmayacak miktardadır (%35). Görüşülenlerin %34’ü daha önce bir suç/suç isnadı davranışında bulunmuştur. Kentleşmeyle birlikte artan insan sayısı ve çeşitlenen suçlara karşı suç sonrası değil suç öncesi uzun vadeli programlar yapılarak mücadele edilmelidir. Çünkü günümüzün en önemli sosyal problemlerinden birisi olan çocuk suçluluğu dünyada olduğu gibi ülkemizde de hızla büyüyen bir sorundur. Abstract : As a social phenomenon, juvenile delinquency is a problem that has been experienced in the world for many years and its number is increasing day by day. Generally, until the 19th century, the same criminal laws were applied to the individuals who were involved in the crime without discriminating between children and adults. In 1899, with the establishment of the Cook County Juvenile Court in Chicago, Illinois, juvenile delinquency cases have been handled with a scientific perspective. In our country, the first studies on juvenile delinquency started after the 1930s. In earlier times, he was late in the psychology of criminal justice and psychology and criminal law because of the lack of adequate statistics and the lack of scientists interested in the subject. The first researches on child offenders have been made in Turkey in 1931. Since then, quantitative and qualitative researches on the solution of juvenile delinquency have begun to be addressed from a broad perspective with sociological, psychological and legal dimensions. The aim of this study is to understand the phenomenon of juvenile delinquency in our country and the social causes leading to this phenomenon in Antalya in a sociological context. The research was conducted between July 7, 2003 and June 30, 2005 in the Children’s Branch of the Antalya Provincial Security Directorate in Antalya. According to the data obtained from the study, almost half of the children (41%) who were involved in the crime in Antalya were the children of the family who experienced a physical environment change due to internal migration. The number of offender models in the family and relatives of children is considerable (35%). 34% of the respondents had previously committed a crime / criminal offense. With urbanization, the number of people increasing and diversified crimes should be tackled by long term programs before crime, not after the crime. Because juvenile delinquency, which is one of the most important social problems of today, is a rapidly growing problem in our country as well as in the world. Due to the lack of sufficient statistics and scientists interested in the subject in earlier periods, child crime has found a late place in criminal sociology-psychology and criminal law. The first investigation of criminals in Turkey was conducted in 1931. From that time to the present day, quantitative and qualitative research on the solution of child crime has begun to be dealt with from a broad perspective with its sociological, psychological and legal dimensions. The purpose of this study is to understand the fact of child crime in our country and the social causes that lead to this fact in the example of Antalya in a sociological context.
