Kuvvet açısından birbirine denk nassların teâruzu, Sahâbe dönemi ile birlikte bir problem olarak tezahür etmiştir. Tikel örnekler üzerinde çözülmeye çalışılan bu problem için, fıkıh usulü ilminin gelişimi ile birlikte sistematik çözüm yöntemleri ortaya konulmuştur. Teâruz, genel olarak cem’/tevfîk, tercih, nesih ve tesâkut yöntemleri ile çözülmeye çalışılmakla birlikte, hiyerarşik açıdan nasıl bir sıralamanın esas alınması gerektiği konusunda üç farklı görüş ortaya konulmuştur. Hanefi usûlcülerin temsil ettiği birinci görüş, nesih, tercîh, cem’/tevfîk ve tesâkut şeklindeki sıralamayı esas alırken, Çoğunluğu oluşturan usûlcüler cem’/tevfîk, tercih, nesih ve tesâkut şeklindeki sıralamayı, hadisçiler ve diğer bazı usulcüler ise cumhurdan farklı olarak neshi tercihe öncelemişlerdir. Yazdığı el-Câmi’u’s-Sahîh adlı eseri ile hadis kaynakları arasında birinci sırada yer alma payesine sahip olan ve bu eserinde oluşturduğu bâb başlıkları ile fıkhi görüşlerini ortaya koyan İmâm Buhârî de, nasslar arasında teâruzu gidermede belli bir yöntem ve hiyerarşi takip etmiştir. Bu makalemizde müteârız delillerin çözümü konusunda Buhârî’nin takip ettiği yöntem ve hiyerarşi tespit edilmeye çalışılacaktır.
