Abstract The article aims to carry out an analysis of the legal norms existing in the Brazilian legal system and MEC guiding documents, to map what has been considered as a concept of quality as necessary for the provision of early childhood education, in the process of specifying to the right to education. Therefore, it starts from a broad concept of quality, including the guarantee of access and other elements for its realization. In the end, it is indicated that in Brazil it is not possible to affirm the absence of qualified discussions on the theme, presenting a summary table with parameters and aspects that make up the quality of early childhood education, whose usefulness resides in the presentation of what the Brazilian legal system and the orientation of the matter in the scope of the executive branch establishes the criteria for the quality of early childhood education.
