Abstract Since 2010 there was an increase in migratory flows, as well as the growth in the number of children crossing Brazilian borders and that makes it necessary to discuss about children's refugee and their right to education as a human right. Therefore, the present paper starts from the following questions: does the Brazilian legal system guarantee the right to education for refugee children? Are there barriers and perspectives for the realization of the right to education as a human right for refugee children in Brazil? To answer these questions, the dialectical method and bibliographic and documentary research techniques are used. First, there is an analysis of laws about refuge and education. Also, in order to investigate the effectiveness of legal provisions, there is a verification in the data made available between 2010 and 2019 about the education of refugee children. Lastly, the concept of education as a practice of freedom is presented from the writings of bell hooks and Paulo Freire.
