Abstract:

In the years when most of the population lived in the countryside, village mukhtar came to mind when the mukhtar was mentioned. Concentration in cities has increased since 1985, when the urban population surpassed the rural population, population in rural areas has decreased. The village, which is the main settlement of the countryside, was affected by this situation. With the Code No. 6360, the legal existence of villages was terminated in provinces with metropolitan status. According to TUIK data for 2021, 93.2% of our country's population lives in cities and 6.8% in villages. Anymore when the headman is mentioned, not the village headman, but the neighborhood headman comes to mind. In other words, neighborhood mukhtar became more visible. Especially in provinces with metropolitan status, neighborhood mukhtar in rural areas have different powers that they have been using for a long time, and various additional duties in this context. In addition, mukhtars are frequently complained about due to personal enmities. For this reason, there is an increase in the number of dismissals of neighborhood mukhtar compared to the past. However, the application of dismissal is applied incorrectly from the legal point of view. In this study, the issue of dismissal of the neighborhood headmen is handled a little more closely. Also in this study, errors and illegalities in practice were tried to be explained; It has been analyzed whether it is possible to dismiss the neighborhood headmen or not.
