ÖZ 6102 sayılı Türk Ticaret Kanunu’nun 1353. maddesi uyarınca bir deniz alacağı ancak ihtiyati haciz ile teminat altına alınabilir. Bu açıdan alacaklının alacağına kavuşması açısından gemilerin ihtiyati haczi büyük önem taşımaktadır. Gemiler ise sürekli olarak denizde hareket eden taşınır eşyadır. Bu nedenle özellikle yabancı bayraklı gemilerin ihtiyati haczi, deniz ticareti hukukununsorunlu alanlarından birisi olmuştur. Türk Boğazları’ndan geçiş yapan yabancı bayraklı gemiler üzerinde Türkiye’nin, ihtiyati haciz yetkisine sahip olup olmadığı tartışmaları da doktrin ve uygulamayı epey meşgul etmiştir. Bu kapsamda, çalışmada Türkiye’nin, Türk Boğazları’ndan geçiş yapan yabancı bayraklı ticaret gemileri üzerindeki hukukî yargı yetkisi tartışılmıştır. Anahtar Kelimeler: Gemi, Türk Boğazları, İhtiyati haciz, Deniz alacağı, Zararsız geçiş ABSTRACT A maritime claim will only be secured in accordance with the article 1353 of the 6102 Turkish Commercial Code. In this respect, cautionary attachment of the ship is very important for creditor to obtain his claim. Ships are movable properties that are sailing in the sea continuously. Therefore, especially the cautionary attachment of foreign flagged vessels have become one of the most problematic areas of maritime law. Whether Turkey has precautionary attachment of foreign flagged vessels’ passage through the Turkish Straits or not has been a discussion in the doctrine and practice. In this context, Legal Jurisdiction of Turkey on foreign flagged merchant ships’ passage through the Turkish Straits is discussed in this study.
