Abstract:

In armed conflicts that are not international, the International Committee of the Red Cross has the right to offer its services to the parties to the conflict. This right is clearly provided for by the Joint Article 3 of the 1949 Geneva Conventions. The parties to which services can be offered due to the nature of non-international armed conflicts are not only the States parties to the Geneva Conventions, but also the non-state armed groups fighting with them. The listing of these groups as terrorist organizations in the national law of the United Nations and the United Nations, as well as international organizations, causes difficulties in terms of the function of the International Committee of the Red Cross as provided for in Article 3 of the Common Treaty. The article evaluates the International Red Cross Committee’s approach to involvement with non-governmental armed groups and the reasons for the challenges it faces.
