Dünyada artan enerji ihtiyacı ve bağımlılığı; tarihsel önemini yüzyıllardır koruyan Doğu Akdeniz’i günümüzde tekrar diplomasinin merkezine çekmeye başlamıştır. Doğu Akdeniz’de bulunan hidrokarbon rezervleri kıyıdaş devletlerin bu rezervler üzerinde arama ve yararlanma hakkı iddia etmeleri ve bu iddia edilmiş haklarını hukuki zemine oturtabilmek için ikili anlaşmalar yapmalarına sebep olmuştur. Ancak bu rezervlerden yararlanma hakkının hem Kuzey Kıbrıs Türk Cumhuriyeti’nin varlığını hem de Türkiye ve Kuzey Kıbrıs Türk Cumhuriyeti arasındaki ikili anlaşmayı göz ardı etmesi sebebiyle bölgede bir takım gerilimler ortaya çıkmaktadır. Kıbrıs adasının hukuki durumu da göz önünde bulundurulduğunda, rezervlerden elde edilen ekonomik değerlerin hem ada halkının ortak çıkarına sunulmaması hem de Türkiye’nin Kuzey Kıbrıs Türk Cumhuriyeti ile anlaşmasından doğan yetki alanlarının gasp edilmesi açısından önemi bulunmaktadır. Bu çalışmada, Doğu Akdeniz’deki tarafların iddia ettiği yetki alanları ve bu alanlardan elde edilen çıktının paylaşımı uluslararası hukuk nezdinde bir zemine oturtulmaya çalışılacaktır. Bu sebeple önce Doğu Akdeniz’deki yetki alanlarının Uluslararası Deniz Hukuku’na uygun biçimde ayrımı yapılacak olup sonrasında Kıbrıs adasının ve Türkiye’nin Doğu Akdeniz’deki konumuna değinilmiştir. Güney Kıbrıs Rum Yönetimi’nin adanın tek söz sahibi ve temsilcisi gibi davranmasının uluslararası hukuka aykırılığından bahsedilecek olup olası çözüm yollarına da değinilmiştir.
The world’s increasing need for energy and dependence, which has kept its historical importance for centuries, has now begun to draw the Eastern Mediterranean back to the center of its diplomacy. The hydrocarbon reserves in the Eastern Mediterranean have led coastal states to claim the right to search and use these reserves and to conclude bilateral agreements to put these claimed rights on the legal ground. However, a number of tensions arise in the region because the right to take advantage of these reserves both ignored the existence of the Northern Cyprus Turkish Republic and the bilateral agreement between Turkey and the Northern Cyprus Turkish Republic. Having regard to the legal status of the Cyprus island, it is important that the economic values obtained from the reserves are not presented to the common interest of the island people as well as that the powers of Turkey arising from the agreement with the Northern Cyprus Turkish Republic are exhausted. In this study, the authority areas claimed by the parties in the Eastern Mediterranean and the sharing of the output obtained from these areas will be sought to sit on a ground for international law. This is why first the authority areas in the Eastern Mediterranean will be distinguished in accordance with the International Maritime Law and then the position of the Cyprus island and Turkey in the Eastern Mediterranean. The Southern Cyprus Rum Administration’s behavior as the island’s only spokesman and representative will be discussed as a violation of international law and the possible ways to resolve it.
The Eastern Mediterranean, which has preserved its historical significance for centuries, has once again become the center of diplomacy due to increasing energy needs and dependence in the world. The hydrocarbon reserves in the Eastern Mediterranean have led the riparian states to claim the right to seek and exploit these reserves and to make bilateral agreements to put these alleged rights on a legal basis. However, that the right to benefit from these reserves ignores both the existence of Northern Cyrup Turkish Republic and bilateral agreements between Turkey and the Turkish Republic of Northern Cyprus has caused a series of tensions in the regions. Considering the legal situation of the island of Cyprus, economic values obtained from reserves have significance in terms of not presenting in the common interest of the people of the island and entrenching upon Turkey’s jurisdiction arising from the agreement with the Turkish Republic of Northern Cyprus. In this study, it will be tried to explain the fields of jurisdiction claimed by the parties in the Eastern Mediterranean and the sharing of the output from these fields on the basis of international law. Therefore, firstly the jurisdiction of the Eastern Mediterranean has been differentiated according to the International Maritime Law and then It has been referred to the location in the eastern Mediterranean island of Cyprus and Turkey. It has been mentioned that the Greek Cypriot Administration's acting as the sole spokesperson and representative of the island is contrary to international law, and then the possible solutions have been addressed.
