Osmanlı Devleti’nde, özel hukuk alanında, İslam hukuku hükümlerine sıkı sıkıya bağlı kalındı. Bu çerçevede kadının aile hukuku içindeki yeri de İslam hukuku kuralları ile sınırlandı. Kadın, namzetlik sürecinden başlayarak, evlilik akdinin yapılmasında, evliliğin ekonomik sonuçlarında ya da çeşitli gerekçelerle talak, muhalaa, fesih yöntemleri ile evliliklerin sonlandırılmasında ve ayrılığın doğurduğu sonuçlarda hep İslam hukuku kuralları doğrultusunda hareket etti. Kadının, aile birliğinin kurulmasından dağılmasına kadar geçen süreçte sahip olduğu haklar da bu sınırlar içinde belirlendi. Bu çalışma, şeriyye sicillerindeki kayıtlardan yola çıkarak, Osmanlı Klasik Dönemi’nde kadının aile hukuku içindeki konumunu somut örneklerle ortaya koymaya çalışmaktadır.
In the Ottoman Empire, the provisions of the Islamic law were strictly followed in the field of private law. In this sense, the position of the women in the family law was limited to the rules of the Islamic law. Beginning from the candidacy phase, women always acted as per the rules of the Islamic law when it came to marriage contract, economic consequences of the marriage or termination of the marriage with divorce, divorce through payment or termination methods and the consequences resulting from divorce due to various reasons. The rights that women had from the foundation of the family unit until its dissolution were set within these boundaries. This study tries to present the position of the women in the family law of the Ottoman Classical Period with concrete examples by looking at the records in cadi registries.
