Abstract:

The International Criminal Court is a permanently independent judicial institution established to prevent and prevent serious crimes that hurt the international community. The Constituent Treaty of the Court, established in July 2002, is the 1998 Rome Statute. Crimes within the jurisdiction of the court in accordance with the purpose of the court are crimes committed against humanity, crime of genocide, war crimes and crime of attack. He has jurisdiction only over individuals. The jurisdiction and administrative structure of the Court, which has been operating for 20 years, as the former Yugoslav International Criminal Court and the International Criminal Court of Rwanda were established in the past. by ad hoc It is based on the experience obtained from the practices of the courts. However, as a result of the gained experience remaining inefficient in the practice, it is observed that a number of deficiencies and/or deficiencies that will reveal the purpose and objectives of the Court are revealed. This study will first provide general information on the jurisdiction and structure of the Court. The court will then consider the judicial and administrative inability that the court will encounter and/or may encounter. These deficiencies/and/or disadvantages will be assessed in the context of the Court’s universality principle, complementarity principle, cooperation and judicial assistance principle, the selection of judges and budget issues.
