Fıkıh geleneğimizde oldukça önemli bir yer tutan tenkit ve eleştirel yaklaşım, farklı fıkıh mezhepleri ya da aynı mezhebe mensup fakihler arasında söz konusu olabilmiştir. Bu kültürün özellikle Ebû Hanîfe’nin fıkıh derslerinde en canlı şekilde yaşatıldığı bilinmektedir. Mezhep içinde eleştirel yöntemi benimseyenlerden biri de Hanefî fıkıh okulunun Osmanlı coğrafyasında yetiştirdiği önemli fakihlerden biri olan Şeyh Bedreddin’dir. Bedreddin’in tenkitlerinin önemli bir kısmını, Hanefî mezhebi imamlarının görüşleri arasında yaptığı sorgulamaları oluşturur. Onun bu eleştirileri mezhep içinde cevapsız kalmamış; Osmanlı Devleti’nin yetiştirdiği büyük âlim Molla Hüsrev fıkha dair eseri ed-Dürer’de isim belirtmeden Bedreddin’in bu itirazlarına sert bir üslupla cevap vermiştir. Bu makalede; Hanefi Hukuk Literatüründe kalıcı izler bırakan bu iki âlimin bahse konu eleştirilerine yer verilmiştir. Konuya giriş mahiyetinde her iki fakihin biyografisi ve fıkha dair eserlerine kısaca temas edilmiş; tartışmalara müdahil olan diğer fakihlerin kanaatlerinden de istifade edilerek bu noktalarda değerlendirmelerde bulunulmuştur.
Criticism and critical approach, which have a very important place in our fiqh tradition, have been existed among different fiqh madhhabs or jurists of the same madhhab. It is known that this culture was kept alive especially in Abu Hanifa’s fiqh lessons. One of those who adopted this critical method by questioning consistency within the sect is Sheikh Bedreddin, one of the important jurists of the Hanafi Fiqh School in the Ottoman geography. His criticisms did not go unanswered within the madhhab the great scholar Molla Husrev, who was educated by the Ottoman Empire, responded to Bedreddin’s objections with a harsh style in his work on fiqh, Durar. In this article, the aforementioned criticisms of these two scholars, who left permanent marks in the Hanafi Law Literature, were included. Biographies of both jurists and their works on fiqh were briefly touched upon as an introduction to the subject evaluations were made on these points by making use of the opinions of other scholars who were involved in the discussions.
