Abstract:

In Turkish law having affair with a married person is not prohibited by any legal provision. It is controversial whether the betrayed spouse may claim non-pecuniary damages from the third person for pure adultery unless this person has violated her/his right of personality by another act. One of the conditions for the claim of compensation for the non-pecuniary damages based on tort liability is the violation of a personality right of the injured party by an act of the tortfeasor. Therefore the main point on the subject of the claim of non-pecuniary damages from the third person is whether the act of the third person violates any personality right of the betrayed spouse. In this paper, it is analyzed whether the mere participation in an act of adultery ay cause tort liability on the base of the unlawfulness or the immorality.
