Fetus acquires the capacity to rights at the moment of conception provided that it is born alive. Regarding to the capacity of rights, there is no difference between an embryo in its mother’s womb and an embryo in vitro. As well as personality right, several patrimonial rights are provided to fetus under the suspensive condition of being born alive. Fetus may be legal heir and may also be appointed as heir or bequeathed by a will. Contracts in favor of a third party may be concluded in favor of a fetus. If it is injured before birth as a result of a tort, once born alive, it may claim compensation for damages as well as for pain and suffering from the tortfeasor. If the fetus loses its future provider, it may claim compensation for the loss of its support
