Bilimsel veriler göstermektedir ki, son yıllarda daha yoğun bir şekilde hissettiğimiz küresel ısınma, dünya çapında iklim değişikliğine neden olmaktadır. Bu noktada, sera gazlarının neden olduğu küresel ısınmanın bir diğer sonucu da elbette buzulların erimesi ve buradan gelen etkiyle deniz seviyelerinin küresel düzeyde yükselmesidir. İklim değişikliğine bağlı deniz seviyesi yükselmesinin, uluslararası hukuk açısından önemli yansımaları olacağı görüşü giderek daha fazla dile getirilmektedir. Devamla, küresel ısınmanın etkisiyle meydana gelen deniz seviyesi yükselmesinin doğuracağı sorunlardan, uluslararası hukukun önemli bir kolu olan deniz hukukunun da önemli ölçüde payını alacağının altı çizilmektedir. Küresel ısınma ve iklim değişikliği, yalnızca deniz seviyesinin yükselmesine neden olmamakta, aynı zamanda uluslararası hukuk tarafından tanınmış ve normatif düzenlemelerle koruma altına alınmış insan haklarının da kullanımını tehlikeye atmakta veya zarar vermektedir. Küresel ısınma ve deniz seviyelerinin yükselmesi konusu, cari uluslararası hukukun geçmişten bugüne gelen kayda değer meselelerinin yanı sıra güncel ve yakın gelecekte önemli mesele haline gelecek konularının ele alınarak tartışıldığı önemli bir forum ve mekanizma olan Birleşmiş Milletler Uluslararası Hukuk Komisyonunun da gündemine gelmiştir. Bu bağlamda biz de çalışmamızda, Uluslararası Hukuk Komisyonunun yapısal olarak meseleyi ele alış tarzı ile bu mesele hakkında en son 2022 yılında yaptığı 73 üncü Oturum raporunda yer verdiği, tartışma, değerlendirme ve açıklamaları ele alarak inceleyeceğiz.
Scientific data show that the global warming that we have felt more intense in recent years has caused climate change worldwide. At this point, another result of the global warming caused by greenhouse gases is, of course, the erosion of the glaciers and the impact of the sea levels on a global level. The view is increasingly expressed that the rise of the sea level due to climate change will be significant reflections in international law. Of the problems that the sea level rises as a result of global warming, it is continued to be drawn up that the maritime law, which is an important arm of international law, will also take a significant part. Global warming and climate change are not only causing sea levels to rise, but also threatening or damaging the use of human rights recognized by international law and protected by normative regulations. The topic of global warming and the rise of sea levels has also come to the agenda of the United Nations International Law Commission, an important forum and mechanism for discussing the important issues of international law from the past to the present, as well as the issues that will become a major issue in the present and near future. In this context, we will also study in our work, discussing the discussions, assessments and explanations, which the International Law Commission has last included in the 73rd Session Report on this issue in 2022, with the way it structurally addresses the issue.
