Alman Hukuku’nda etkili olan normatif zarar, malvarlığında herhangi bir azalma söz konusu olmasa bile zararın karşılanmasını öngören bir kuramdır. Bu açıdan zararın tazmininde dikkate alınan fark teorisinden ayrılmaktadır. Normatif zararın bir çeşidini ev işlerini yürüten eşin zararı oluşturmaktadır. Ev işlerini yürüten eş, vücut bütünlüğünün ihlali sonucunu doğuran bir fiille karşı karşıya kalıp da ev işlerini göremez hâle gelirse ve çalışma gücünü kaybederse tazminata hak kazanabilmektedir. Ev işlerini yürüten eşin zararı, geleneksel anlamda bir zarar değildir, çünkü tazminata hak kazanan kişi, malvarlığı değerlerinde herhangi bir kayıp yaşamamıştır. Alman Hukuku’nun aksine İsviçre Hukuku’nda ev işlerini yürüten eşin zararının tazmin edilmesi konusunda tam bir görüş birliği bulunmamakta ve fakat çoğunlukta olan görüş, zararın tazmin edilmesi noktasında birleşmektedir. Türk Hukuku’nda doktrinde belirtilen birkaç görüş dışında ev işlerini yürüten eşin zararı üzerinde pek durulmamıştır. Normatif zarar kapsamında ev işlerini yürüten eşin uğradığı zarara ilişkin olarak Türk Yargı uygulamasında da çok fazla karara rastlamak mümkün değildir. Özellikle yeni tarihli kararların varlığı oldukça azdır.
Normative damage is a theory in effect in German Law that provides compensation for the damage even if there is no decrease in the assets. In this respect, it differs from the theory of difference, which is considered in compensation for damage. One type of normative damage is housewife damage. If the housewife who carries out the housework is faced with an act that results in a violation of her bodily integrity and becomes unable to do her housework and loses his ability to work, she may be entitled to compensation. Housewife damage is not a loss in the traditional sense, because the person entitled to compensation has not suffered any loss of property value. Contrary to German Law, in Swiss Law, there is no consensus on the compensation of the loss of the housewife damage, but the majority opinion agrees on the compensation of the damage. In Turkish Law, except for a few opinions stated in the doctrine, the housewife damage has not been emphasized much. It is not possible to come across many decisions in the judicial practice in Turkish Law regarding the damage suffered by the housewife within the scope of the normative damage. In particular, the number of recent decisions is very low.
