Covid-19 Salgınından kaynaklanan uluslararası sorumluluğun nasıl belirleneceği uluslararası hukuk açısından önemli bir tartışma konusudur. Bu çalışma dâhilinde bu tartışlarının sebep olduğu ihtilaflar ve neticeler değerlendirilecektir. Sorumluluğun kime ait olduğu kadar zararın tazmini konusu da mühimdir. Ayrıca devletlerin ve uluslararası örgütlerin uluslararası hukuk açısından sorumluluklarının nasıl düzenlediği genel çerçevede incelenecektir. Sorumluluk kavramı kadar sistematik biçimde düzenlenmemiş olsa dahi özen yükümlülüğü uluslararası hukuk açısından zararın tazminine ilişkin üstünde durulması gereken önemli bir konudur. Dünya Sağlık Örgütü'nün uluslararası sorumluluklarını gerektiği gibi yerine getirememesi ve Covid-19 Salgını'nın yayılması noktasında gereken özeni göstermemesi, uluslararası sorumluluğun belirlenmesi noktasında gözden kaçırılmamalıdır. Bütün dünyayı etkileyerek milyonlarca insanın hayatını kaybettiği ve devletlerin ekonomik zarara uğradığı Covid-19 Salgını’na ilişkin sorumluluğun kime ait olduğu tartışmaları çalışmamıza dâhil edilen sorumluluk hukukunu tekrardan gündeme getirmiştir.
Covid-19 is an important topic of debate in terms of international law on how to determine international responsibility caused by the Covid-19 infection. In this study, the disputes and outcomes caused by these discussions will be assessed. The responsibility for damages is equally important to whom the responsibility belongs. It will also be examined in the general framework of how states and international organizations regulate their responsibilities in terms of international law. Even though the concept of liability is not systematically regulated as the concept of liability is an important issue that must be focused on compensation for damages in terms of international law. The fact that the World Health Organization is unable to fulfill its international responsibilities as necessary and that it does not show the necessary support at the point of spread of the Covid-19 infection should not be overlooked at the point of determination of international responsibility. The debate on who the responsibility for the Covid-19 in which millions of people have lost their lives and the economical damage of the states has affected the whole world has re-established the law of responsibility, which is included in our study.
