Kur’ân-ı Kerîm’deki ahkâma dair mevzuları esas alan fıkhî tefsir ekolü, tefsir tarihinin önemli yöneliş ve yöntemlerinden biridir. H. 150’de vefat eden Mukâtil b. Süleymân’ın tefsiri bu alanın ilk örneğini teşkil etmektedir. Sonraki dönemlerde müfessirler mensubu bulundukları mezhebin usûl ve esaslarını dikkate alarak Ahkâmü’l-Kur’ân adı altında önemli eserler vermişlerdir. Hanefî mezhebinden Ebû Bekr el-Cessâs’ın (ö. 370/981) Ahkâmü’l-Kur’ân’ı, Şâfiî mezhebinden Kiyâ el-Herrâsî’nin (ö. 504/1110) Ahkâmü’l-Kur’ân’ı, Mâlikî mezhebinden Ebû Bekir İbnü’l-Arabî’nin (ö. 543/1148) Ahkâmü’l-Kur’ân’ı bu alanda öne çıkan tefsirlerdendir. Bu konuda yazılan tefsirlerden biri de tefsir, hadis, fıkıh ve Arap dili ve edebiyatı gibi pek çok alanda eser veren Ebü’l-Fadl Celâlüddîn es-Süyûtî’nin (ö. 911/1505) el-İklîl fî istinbâti’t-tenzîl adlı tefsiridir. Süyûtî’nin bu kitabı, ictihâd, istinbât ve Fıkhu’l-Kur’ân alanındaki çalışmalara kaynaklık eden bir tefsirdir. Makalenin amacı, el-İklîl tefsiri ekseninde Süyûtî’nin istinbâtta bulunduğu meseleleri incelemektir. İlk olarak ahkâmü’l-Kur’ân’a dair bilgiler verildikten sonra istinbât kavramının lügavî ve istılâhî manası ele alınmış, sonra el-İklîl tefsirinin yazılış amacı, kaynakları ve ilgili eser üzerine yapılan çalışmalar incelenmiştir. el-İklîl adlı çalışmada sade ve akıcı bir dil kullanan Süyûtî, âyetlerin tamamını tefsir etmek yerine istinbâta konu olan âyet veya âyetin ilgili kısmını açıklamakla yetinmiştir. İmâm Süyûtî, Kur’ân’ı Kur’ân’la, Kur’ân’ı hadisle tefsir etmeyi öncelikli görmüş, âyetlerde geçen kelimelerin manalarını zikretmiştir. Süyûtî, bu eserinde diğer tefsirlerden farklı olarak sadece fıkhî meseleleri istinbât etmekle iktifa etmemiş, âyetlerden usûl, kelâm, tasavvuf ve bilim gibi meseleleri de istinbât etme cihetine gitmiştir. Bu çalışmanın neticesinde ahkâm tefsirlerinde âyetlerden fıkhî meseleleri çıkarma anlamında kullanılan istinbât kelimesinin el-İklîl fî istinbâti’t-tenzîl tefsirinde anlam genişlemesine uğradığı görülmüştür.
The school of fiqh tafsir, which is based on the issues related to the decrees in the Qur'an, is one of the important methods in the history of tafsir. Died in 150, Hijri, Mukâtil b. Suleiman has the first example of tafsir in this field. In the following periods, interpreters produced important works under the name of Ahkâm al-Qur'an, taking into account the principles and procedures of the sect they belonged to. Ahkam al-Qur'an of Abu Bakr al-Cassas (d. 370/981) from the Hanafi school, Ahkam al-Qur'an of Kıya al-Harrasi (d. 504/1110) from Shafii school, The Ahkam al-Qur'an of Abu Bakr Ibnu'l-Arabi (d. 543/1148) from the Maliki school are important commentaries written in this field. One of the tafsirs written on this subject is el-İklil fi istinbath al-tanzil written by Ebu'l-Fadl Jalal al-din al-Suyuti (d. 911/1505) who write works in many field such as tafsir, hadith, fiqh and Arabic language and literature. This book of Suyuti is a tafsir that is the source of studies in the field of ijtihad, istinbat and Fiqhu'l-Qur'an. The aim of the article is to examine the issues that Suyuti istinbath in the axis of al-Iklil tafsir. First, after giving information about the Ahkam al-Qur'an, the lexical and grammatical meaning of the concept of istinbath is discussed, and then the purpose of writing the el-İklîl tafsir, its sources and studies on the relevant work are examined. Suyuti, who used a simple and fluent language in his work called al-Iklil, contented himself with explaining the verse or the relevant part of the verse that is the subject of istinbath, instead of interpreting the entire verses. He prioritizes interpreting the Quran with the Quran and the Quran with hadith and also mentioned the meanings of the words in the verses. In this work, Suyuti, unlike other tafsir, did not confine himself to only fiqh issues, but also deduced issues such as usul, Islamic theology, sufism and science from the verses. As a result of this study, it has been seen that the word istinbath, which is used in the ahkam tafsirs to mean removing fiqh-related issues from the verses, has expanded in meaning in this tafsir.
