Abstract:

Dworkin constructs his understanding of justice in cooperation with his views about theory of law. He tried to develop a “right-based” understanding of justice to solve the problems of philosophy of law. Dworkin, who put the rights at the center of his theory, reduced the justice issue to the rights issue, and made a deep connection between them. Entire theory of Dworkin could be interpreted as a defense of rights. In fact, Dworkin tried to reinterpret the concepts of justice, freedom and equality while taking the rights seriously. According to Dworkin, the most fundamental right of the individual before the state is the right of “equal share of respect and resources”. Dworkin, who is reducing the problem of justice to the problem of right and placing the equality in the center of rights, puts a set of regulations forward to realize this equality. These regulations are auction, the envy test, and insurance model. Dworkin advocated that governances should consider these regulations while providing justice.
