Abstract:

Debtors in violation of its commitment to pay within the specified time can be punished with a 3 month or 1 year of imprisonment known as preventive detention if they fail to fulfill their commitments. This fine is a possible application that can lead further business deterioration of small retailers and farmers who are in debt payment difficulties. These people can probably meet the dangers of professional crime in the prisons when they have chance to speak to “professional” criminals of the prisons. Punishment, Abandonment of restricting freedom for a simple economic crime and punishment both prevents job losses and also removes the perception of rogue tradesmen and farmers. The reasons of abondenment of imprisonment for bad cheque should be applied to the fines sentenced for violation of the payment commitment, too. In this contex, it is suggested that relevant law should be revised again and preventive detention must be removed.
