“Uluslararası Ceza Mahkemesi Kurulmasına İlişkin Tam Yetkili Temsilcilerden Oluşan Birleşmiş Milletler Diplomatik Konferansı”, 15 Haziran 1998 tarihinde Roma’da toplanmıştır. Uluslararası Ceza Mahkemesi Statüsü, Roma Konferansının son günü olarak ilan edilen 17 Temmuz 1998 tarihinde kabul edilmiş; 1 Temmuz 2002 tarihinde yürürlüğe girmiştir. Mahkemenin kurulmasına ilişkin Andlaşma metninde, devlet egemenliğine kısıtlama getiren hükümler yer almaktadır. Bunlar arasında, m. 12/2’de düzenlenen “ülkesellik kriteri”; Giriş Bölümünün 10. paragrafında düzenlenen “tamamlayıcılık ilkesi” ve m. 13/b ve m. 16’da düzenlenen Güvenlik Konseyinin mahkemenin işleyişi üzerindeki yetkileri bulunmaktadır. Bu kapsamda yapılan inceleme sonucunda, Uluslararası Ceza Mahkemesinin varlığının, uluslararası hukuk ve devlet egemenliği açısından farklı ve özel bir anlam taşıdığı açıkça görülmektedir. Bu bağlamda, çağdaş uluslararası hukukta oluşmakta olan ortak kanıya göre, neredeyse tüm evrensel yargı uygulamaları, bir şekilde, egemenlik iddialarıyla çatışmaktadır. İnsan haklarıyla ilgili olarak yargı sürecinde devlet egemenliğine uluslararası müdahale süreci, Uluslararası Ceza Mahkemesinin çalışmaya başlamasıyla son halini almıştır.
