İslam hukukunda birtakım kriterlerle tespit edilmiş, dini bakımdan zengin-fakir ayrımı bulunmaktadır. Zenginliğin belirli kesimlerin elinde birikmesinin önüne geçilerek, refahın toplumun tüm kesimlerine yayılması, toplumsal huzurun sağlanması amaçlanmaktadır. Bu çalışmada İslam Hukukunda fakir ve miskin olarak isimlendirilen, toplum içerisinde zorunlu ihtiyaç maddelerini temin edemeyen, gerçek yoksul kimselerin niteliklerinin belirlenmesi hedef alınmaktadır. Bakara suresi 273. ayetinde ifade edildiği gibi bu özellikler: Allah yolunda olma, Yeryüzünde dolaşamama, Zengin zannedilme, Yoksulluklarının yüzlerinden anlaşılması ve Israrla istememe şeklinde sıralanmaktadır. Bu kesime yapılacak yardımlarda özellikle belirlenen nitelikler aranınca, öncelikle gerçek ihtiyaç sahibi kimselere ulaşılması ve onların ihtiyaçlarının giderilmesi sağlanmış olmaktadır.
The Islamic law is defined by a number of criteria, and there is a difference between the rich and the poor in terms of religion. By preventing the accumulation of wealth in the hands of certain sections, the purpose is to spread prosperity to all sections of society, to ensure social peace. This study is aimed at determining the qualities of real poor people, who are called poor and poor in Islamic Law, who are unable to provide the necessary materials within the society. In verse 273 of the Qur’an, these characteristics are sorted in the form of being on the way of Allah, not walking in the earth, not being considered rich, not understanding from the faces of their poverty, and not asking for it. In this section, when special qualifications are searched for, it is first guaranteed to reach those who are in real need and to meet their needs.
