Abstract:

ÖZET Dolandırıcılık suçu ülke mevzuatlarına geç girmiş bir suç türüdür. Türk hukukunda hem 765 sayılı Türk Ceza Kanununda (TCK) ve hem de 5237 sayılı Kanunda düzenlendiğini görmekteyiz. Dolandırıcılık suçunun oluşması için aranan unsurlardan biri de hiledir. Hilenin nasıl gerçekleştirileceği TCK’da tanımlanmamıştır. Doktrin ve uygulama tarafından belirlenmektedir. Hilenin gerçekleştirildiği zaman dolandırıcılık suçunun oluşması açısından önemlidir. Dolandırıcılık suçu, yararın sağlanmasıyla tamamlandığından yararın sağlanmasına kadar gerçekleştirilen hile suçun oluşmasını sağlamaktadır. CHEATING AND THE TIME OF CHEATING IN THE CRIME OF FRAUD ABSTRACT The crime of fraud is a type of crime that has been included in the country's legislation late. In Turkish law, we see that it is regulated both in the Turkish Penal Code (TCK) No. 765 and in Law No. 5237. One of the elements sought for the occurrence of fraud is cheating. How the cheating will be carried out is not defined in the TCK. It is determined by doctrine and practice. The time the cheating is performed is important in terms of the occurrence of the fraud crime. Since the crime of fraud is completed with the provision of the benefit, the cheating carried out until the benefit is provided creates the crime.
