Abstract:

In addition to Article 111/a of the ICC and ICC Act, a new sale procedure has been adopted. In this framework, the debtor, by recognizing the sale authority, has the possibility of converting his own property into money. The introduction of a regulation in this direction in our law has made it necessary to investigate the "vente amiable" institution, which is a similar regulation in French law, and to investigate the similarities and differences between the respective institution and Article 111/a of the Law of Execution and Inflas. The provisions of our law, unlike the provisions of French law, do not distinguish between the goods that are transferred and the non-transported; the conversion of all goods into money is followed by the same provisions. Furthermore, the French law provides that the recipient or recipient is in an extremely active position throughout the sale process, while they are able to control all transactions; in our law, there is no provision for the recipient or recipient to object to the debtor during the sale process; the process is completely abandoned to the debtor's will; the debtor has been deemed sufficient to find a recipient to pay the minimum price necessary for sale, and that the price is deposited within fifteen days.
