Abstract:

The bankruptcy delaying institution, which is used for the purpose of repair and refinancing the financial structure of damaged capital companies and co-operatives, has been removed from application with the Law No. 7101 of the Execution and Bankruptcy Act and the Law on Amendments to Certain Laws, published on 15.03.2018 and in the Official Gazette No. 30361. With the delay of the bankruptcy institution, the concordato institution that is part of our legal system but almost never applied has begun to be used by making it more efficient with structural changes. The Concordato institution requires agreements within the framework of certain rules of debtors and recipients on the certification by the court, and the conclusion of the agreement within a certain period of time makes the certain period of time important. With the approval of the certain period by the court, the provisions and consequences that may arise are binding to all parties. In the law, there are several subjects that regulate the consequences of concordatons. The provisions concerning the results of the concordatons are regulated by different subjects. In this study, the results of the concordatone were studied in separate titles, in different situations and facts. In the study first, the concordato process was thoroughly examined, and the temporary and precise termination included in the concordato institution was addressed in the legal perspective. After that, the concordato institution was assessed the results in terms of receivable, debt and contracts. It is believed that the exact timetable will contribute to the scope of this work, where the results are assessed by all parties.
