Cloning is the creation of a genetic twin of a living thing by the use of a somatic cell which taken from a living adult. This process then occurs in the form of egg transfer to the uterus. Cloning is also called as “copying” because the clone is identical with the one the somatik cell as taken from. Cloning has brought ethical, legal and medical issues such as, dignity of both lives (who give the cell and who give the egg), disruption of the natural equilibrium, effect to descent, whether the clone will be accepted as a new person or same as cloned person. In this study, cloning will be handled in terms of penal policy. Criminal law tools which can be used in the framework of the rule of law (acceptance of cloning as a crime and impose criminal sanctions against it) will be examined in terms of requirement of cloning prohibition
