Abstract:

Disabled people experience various health, education and employment issues and are among disadvantaged groups in this sense. Article 25 of the 1948 Universal Declaration of Human Rights states that everyone should be protected in the event of disabilities. The United Nations Convention on the Rights of Persons with Disabilities also regulates the rights of persons with disabilities and the obligations of the States Parties. In accordance with Article 27 of this Convention, the States Parties shall ensure and support the realization of the right to work. In Turkey, there are numerous legal regulations on disabled persons. One of these is Article 30 of the Law No. 4857. In this case, the employers are obliged to work with disabled workers in their workplaces. Accordingly, employers employing fifty or more workers are obliged to employ a certain number of disabled workers in jobs in accordance with their professional, physical and mental conditions. This number is three percent in the private sector and four percent in the public sector. The number of workers in which the employer has more than one workplace within the same province limits is required to work within this scope is calculated according to the total number of workers. This study aims to examine Article 30 of the Labour Act within the relevant legislation.
