Mali yapısı bozulmuş sermaye şirketleri ve kooperatiflerin iyileşmesi amacıyla İcra ve İflas Kanunu’ndaki iyileştirme yöntemlerinden en sık başvurulan olan iflasın ertelenmesi kurumu, olağanüstü hâl süreci içinde işlerliğini yitirmiş, son olarak 15 Mart 2018 tarih ve 30361 sayılı Resmi Gazete’ de yayımlanan 7101 sayılı İcra ve İflas Kanunu ve Bazı Kanunlarda Değişiklik Yapılması Hakkında Kanun ile iflasın ertelenmesine ilişkin hükümler yürürlükten kaldırılmıştır. 7101 sayılı Kanun’la, mali durumu bozulmuş borçluların darboğazdan çıkarak iyileşmelerine imkân sağlayacak konkordato hükümlerinde önemli değişiklikler yapılmıştır. Konkordato hukukunda yapılan bu önemli yapısal değişiklikler ile kurum bambaşka bir çehreye kavuşmuştur. Çalışmada bu değişikliklerle birlikte konkordato kurumu kapsamlı olarak değerlendirilmiştir.

The bankruptcy postponement institution, which is most frequently used in the improvement methods of the Execution and Bankruptcy Law in order to improve the financial structure of capital companies and cooperatives, has lost its function with time of the state of emergency. Then, it has been reorganized as Executive and Bankruptcy Law No 7101 published in the Official Journal dated 15 March 2018 and numbered 30361. With Law No 7101, significant changes were made to the concordat, that would enable restructing option for poor debtors. With these important structural changes made in the law of concordat, the institution has got a different viewpoint. In this study, the concordat institution has been evaluated extensively with these changes
