Abstract:

In today’s anarchist-qualitative international system, where widespread and systematic human rights violations are frequently found, the approach of protection responsibility as a solution for ensuring the protection of both human rights and international peace and security should not be left beyond the international law that remains unresolved in the face of intra-government conflicts. The protection responsibility, which seeks to complete the missing and problematic aspects of human intervention, is attempted to include the right of intervention to protect civilians in state conflicts through openings such as responsibility while protecting, responsible protection and focus points initiatives in international law. The deficiencies in the contents of their approaches and derivatives, and the negative consequences that the practices produce differently from the theory, weaken the legitimacy and prevent the formation of an international law standard. Although the long way to ensure the legitimacy of the approach to protection liability remains to be taken, the frequent inclusion of the United Nations decisions, statements, reports and court decisions, the intense work of inter-governmental and non-governmental international organizations/STKs and the successful intervention practices carried out by the international community brings hope for the future. In this context, the success of the international community’s protection responsibility in the prevention phase in the face of the internal conflicts in the 2007 Kenya elections has raised expectations for the development of the approach. The aim of this study is to evaluate the current situation of the approach to keep the future of the protection responsibility approach light and to evaluate the contribution of successful diplomatic intervention by the international community to the development of the protection responsibility process in the face of the internal conflicts in the 2007-2013 Kenya elections.
