Abstract:

Regional Courts of Justice are regulated by the 5235 numbered Law on the Establishment, Duties and Authorities of the Judiciary Courts of First Instance and Regional Courts of Justice. The regional courts of justice consist presidency, presidential board, chambers, prosecution office, justice commission and directorates. Thus, the judicial system, which consists of two grades, has become three grades. Appeal is also referred to as a legal remedy. The right to appeal provides carnal and legal control of first instance courts’ decisions. In the classic sense, viz. in the broad sense, a new judgment is made by ignoring the first decision which is given first. According to the assessments of the Ministry of Justice, about 90% of the decisions made in the first instance courts will become final with an appeal examination and thus the criminal proceedings will be completed within a reasonable time. In addition, the appellate courts will serve more to achieve substantive truth by conducting both material and legal supervision. The Court of Cassation will thus fulfill the task of creating jurisprudence by looking at less criminal jurisdiction and conducting only juridical inspection
