Article 53/3 of the Law on Foreigners and International Protection provides that foreigner, legal representative or lawyer may appeal against the deportation decision to the administrative court within fifteen days as of the date of notification. Such appeals shall be decided upon within fifteen days. The decisions of the administrative courts made in deportation cases are final. Thus the recourse to the superior court against the decision relating to deportation of the administrative court has been prevented. However, through the amendment made in 2014 to Article 45 of the Law on Procedure of Administrative Justice, the intermediate appeal system has been introduced into the Turkish administrative justice law. In this context, according to Article 45/1 of the Law on Procedure ofAdministrative Justice, the decisions of the administrative court may be appealed, notwithstanding any contrary provisions in the other Laws. In this article, it will be analyse the effect of this regulation about the intermediate appeal to the cases relating to the deportation decision.
