6537 sayılı Kanun ile Türk Medeni Kanunu (TMK) miras hukuku kitabında yer alan tarımsal işletmelerin özgülenmesine ilişkin hükümler yürürlükten kaldırılmıştır. Yapılan değişiklikle birlikte özgüleme sistemi yerine mülkiyetin devri sistemi kabul edilmiştir. Bu sistemle beraber terekedeki tarım arazisi, mirasçıların anlaşması halinde iradi olarak aksi halde belirlenecek ehil mirasçıya ya dayüksek teklif veren mirasçıya veya satış yoluyla üçüncü kişilere kazaî olarak devredilmektedir. Çalışmamızda, bu sistemin medenî usul hukuku bakımından ortaya çıkardığı sorunlar ve çözüm önerileri ve tarım arazisinin devrine yönelik davanın hukukî niteliği, etki ve sonuçları, yetkili mahkemenin tespiti ve mahkemenin verebileceği kararlar medenî usul hukuku müesseseleri ile açıklanmaya çalışılmıştır.
The provisions of Law No. 6537 and the Turkish Civil Law (TMK) on the privatization of agricultural enterprises contained in the heritage law book have been repealed. With the changes made, the property transfer system was accepted instead of the self-release system.
