Abstract:

Önemle belirtmek gerekir ki, gerek 818 sayılı Borçlar Kanunu gerekse 6098 sayılı Türk Borçlar Kanunu büyük ölçüde İsviçre Borçlar Kanunundan esinlenerek yürürlüğe girmiştir. Özellikle, 818 sayılı Borçlar Kanunu hükümleri ile İsviçre’de yürürlükte olan Borçlar Kanunu hükümleri neredeyse aynıdır. Bu yüzden İsviçre Borçlar Kanunu mehaz kanunumuz olarak da nitelendirilmektedir. İsviçre’de kanun koyucu değişen sosyal ve ekonomik ihtiyaçları ve mevcut Borçlar Kanunu’nun uygulamada yarattığı sorunları dikkate alarak İsviçre Borçlar Kanunu 2020 Tasarısını tartışmaya açmıştır. Çalışmamızda, İsviçre Borçlar Kanunu 2020 Tasarısında “Aşırı yararlanma” ve “İrade sakatlığı” hükümlerinin düzenlenişi ve Türk Borçlar Kanunu ile karşılaştırılması konuları ele alınacaktır.

It is important to note that, if necessary, the Law No. 818 on Debt, the Law No. 6098 on Turkish Debt, has entered into force largely by the Switzerland Debt Act. In particular, the provisions of the Debt Act No. 818 and the provisions of the Debt Act in force in Switzerland are almost the same. The Switzerland debt law is also called the law of the Switzerland. In Switzerland, the lawmaker has opened the draft Swiss Debt Act 2020 to debate, taking into account the changing social and economic needs and the problems created by the current Debt Act in the implementation. In our work, the draft Swiss Debt Act 2020 will discuss the issues of regulation of the provisions of "excessive benefit" and "invalidity" and comparison with the Turkish Debt Act.
