Abstract:

KİT personelinin hukuki statüsü zaman içinde değişime uğramıştır. 1961 ve 1982 Anayasalarında KİT personelinin farklı şekilde tanımlanması, 1980 sonrası dönemde özelleştirme ve devleti küçültme politikalarının uygulanması, kamuda istihdamı azaltma ve personel verimini artırma isteği ile bu uygulamaların yargı kararlarıyla yorumlanması, KİT sözleşmeli personelinin statüsünün değişiminde etkili olmuştur. Bugün gelinen aşamada KİT sözleşmeli personelinin kamu personeli olmakla beraber Anayasa’nın 128. maddesinde yer alan personel kapsamında olmadığı, diğer kamu personeli ve ayrıca diğer sözleşmeli personel statülerinden de farklı, kendine özgü bir statüsü olduğu anlaşılmaktadır
