Mal veya hizmet satımından kaçınma suçu, Türk Ceza Yasası’nda ekonomi, sanayi ve ticarete ilişkin suçların düzenlendiği bölümde yer almaktadır. Bu haliyle ekonomik suç vasfına sahiptir. Ticaret hayatının aktörleri, ekonomik faaliyetleri yerine getirirken, kamu için acil ihtiyaçların ortaya çıkmasına neden olacak biçimde hareket edemezler. Bu yönde gerçekleştirilen fiiller, ekonomik hayatın düzen içinde işlemesi esasına duyulan güveni zedeleyecektir. Bu nedenle yasa koyucu tarafından bu nitelikteki filler yaptırıma tabi kılınmış ve bir suç olarak düzenlenmiştir.
The crime of avoiding the sale of goods or services is included in the section in which crimes related to economy, industry and trade are regulated in the Turkish Criminal Law. This is an economic crime. The actors of the business life cannot act in a way that will cause emergency needs to the public, while carrying out economic activities. The facts performed in this direction will undermine the trust in the processing of the economic life in order. Therefore, by the lawmaker, the elephants of this qualification were subjected to sanction and was arranged as a crime.
