Bireylerde kamu görevlisinin görevini ifa ederken sadakat ile görevinin gereklerine uygun davranacağı ve kamu idaresinin muntazam bir şekilde işleyeceğine dair inanç ve güven bulunmalıdır. Bu güvenin korunması, devletin devamlılığını sağlamaya hizmet etmektedir. Kamu idaresine duyulan güvenin sarsılmasına yol açan fiillerden biri de kamu görevlileri tarafından gerçekleştirilen zimmet olup bu suç, Türk Ceza Kanunu (TCK) başta olmak üzere çeşitli kanunlar ile cezai yaptırıma bağlanmıştır. Çalışmamız kapsamında yalnız TCK’da düzenlenen zimmet suçu, suç sistematiğine uygun olarak incelenecektir.
Individuals must have faith and confidence that the public officer will behave in accordance with the requirements of his duty while performing his duty and that the public administration will be treated properly. The preservation of this confidence serves to ensure the continuity of the state. One of the facts that led to the shock of trust in the public administration is the crime carried out by public officials and this crime is linked to criminal sanctions by various laws, including the Turkish Criminal Code (TCK). In the framework of our work, the crimes committed only in the TCK will be investigated in accordance with the criminal system.
Individuals should have faith and trust that the public servant will behave in accordance with the requirements of his/her duties while performing his/her duties and that the public administration will function properly. Maintaining this trust serves to ensure the continuity of the state. One of the acts that causes the loss of trust in public administration is embezzlement by public servants and it is subject to criminal sanctions by various laws, particularly in the Turkish Criminal Code (TCC). Within the scope of our study, crime of embezzlement held in the TCC will be examined in accordance with the criminal review methodology.
