So many results that aren't mine?

İltimas vazifeye getirilme, görevde yükselme, ihale alma gibi durumlarda akrabalık, eş-dost, tanıdık, siyasi yakınlık vasıtasıyla menfaat sağlama, adam kayırma anlamında kullanılır. İslam hukukunda dil, din, ırk, mezhep, cinsiyet, makam, şöhret gibi faktörlerden dolayı insanlara farklı muamelede bulunmak, hak etmediği halde sırf tanıdık olmak, aynı aileden veya aynı siyasi çevreden olmak gibi nedenlerle bir kişiye menfaat sağlamak yasaklanmıştır. Her türlü yetki ve vazifelendirmelerde mesleki ve ilmi yönden yeterliliği olan, kabiliyeti ve gayreti yönüyle liyakati olan, göreve getirilmeyi hak edecek kadar elverişli olan kişiye öncelik tanınması emanetin ehline verilmesini sağlar. Kamu görevlerinde özellikle yargı kurumunda görev yapacak kişilerin ehliyet ve liyakat sahibi olmaları hayati önem taşır. Adil yargılamanın temel unsurlarını oluşturan bağımsız ve tarafsız yargılama için öncelikli olan husus, her türlü iltimasın önüne geçilmesidir. Yargıda iltimas, davanın taraflarından birisi için özel muamelede bulunmak şeklinde gerçekleşir. İslam hukukunda kişilere özel muamele ile ayrımcılık yapılmasını engellemek adına pek çok önleyici uygulama ve düzenlemeye yer verilmiştir.

Abstract:

Favor; In cases such as being appointed to the task, promotion in office, getting a tender, it is used to mean benefiting through kinship, friendship, acquaintance, political affinity and nepotism. In Islamic law, it is forbidden to treat people differently due to factors such as language, religion, race, sect, gender, position, reputation, and to provide benefits to a person for reasons such as being unworthy, just being familiar, being from the same family or from the same political circle. In all kinds of powers and duties; Giving priority to a person who is professionally and scientifically competent, who has merit in terms of his ability and effort, and who is eligible enough to be appointed to duty, ensures that the trust is given to the competent person. It is vital that those who will serve in public offices, especially in the judicial institution, have the competence and competence. The priority for an independent and impartial trial, which constitutes the basic elements of a fair trial, is to prevent any kind of favoritism. Benefit in the judiciary takes place in the form of special treatment for one of the parties to the case. In the Islamic law, many preventive practices and regulations are included in order to prevent discrimination with special treatment.
