Abstract:

Bu makalenin amacı Türkiye’de 12 Eylül 1980 darbesi sonrası ortaya çıkan 1982 Anayasasını ve askeri yönetimin uygulamalarını temel hak ve hürriyetler açısından Michel Foucault’nun hukuk-iktidar ilişkisi analizi üzerinden incelemektir. Önce-likle Foucauldian iktidar düşüncesi ve özneleşme pratikleri incelenmiş, ardından hukukun iktidar ilişkilerindeki konumu belirlenmiştir. Foucauldian teorik çerçeve temel alınarak 1980 darbesi sonrası hukukun iktidar ilişkilerindeki rolü ve temel hak ve hürriyetlere karşı özel konumu ortaya çıkarılmıştır.

Abstract:

This paper aims to analyze the Constitution of 1982 drawn up after the coup d’État of 12 September 1980 and military government practices, regarding fundamental rights and freedoms from Foucault’s analysis on the law/power relationship. Foucauldi-an thought of power and subjectivization practices were first examined, the position of law in power relations was determined thereafter. Based on Foucauldian theoretical framework, the role of law in power relations and its special position towards fundamental rights and freedoms after the 1980 coup d’État were revealed.
