Konkordato projesinin kabulü için oylamaya katılacak alacaklılar, konkordato projesinden etkilenen alacaklılardır. Rehinli alacakların teminatsız kalan kısmı projeye dâhil edilecektir. Rehin hakkı, konkordato hukuku bakımından ayrıca incelenmelidir. Zira rehnin kim tarafından verildiği oylamaya katılacak alacaklıların belirlenmesi bakımından önem arz etmektedir. Borçlu borcuna karşılık kendisi rehin gösterebileceği gibi üçüncü bir kişi de borçlunun borcuna karşılık rehin gösterebilir. Konkordato hukuku bakımından da rehin konusu malın malikinin üçüncü kişi olması halinde alacağın, adi alacak mı rehinli alacak mı olduğu tartışmalar arasındadır. Bu çalışmada İcra ve İflas Kanunu’nun konkordatoya ilişkin hükümleri, doktrin ve Yargı kararları ışığında üçüncü kişi rehniyle temin edilen alacağın konkordatodaki hukuki durumu incelenmiştir.
