Malpraktis - komplikasyon ayrımı Tıp hukukunun temel konularından birisidir. Tıbbi malpraktis sebebiyle sorumlu tutulan hekimlerin, komplikasyon sebebiyle sorumlu olmayacakları kabul edilmektedir. Yargı uygulamasında dikkat edilmesi gereken hekimin sorumluluğunun kusursuz sorumluluğa yaklaştırılmamasıdır.
